Welcome to SVIK SOLUTION. These Terms and Conditions ("Terms") govern your access to and use of our website, platform, and digital services offered by SVIK SOLUTION ("Company", "we", "us", or "our"), a software development and SaaS company registered and operating from Hyderabad, Telangana, India.

By accessing our website or purchasing our services, you ("User", "Customer", "you") agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account, purchasing a plan, or using any of our digital services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and SVIK SOLUTION.

2. Service Description

SVIK SOLUTION provides 100% digital services including:

• WhatsApp Business SaaS platform
• Custom software development (delivered digitally)
• Business process automation systems
• API integration services
• AI-based digital solutions

All services are digital in nature. No physical products, hardware, or goods are sold, manufactured, or shipped by SVIK SOLUTION. All deliverables are provided electronically.

3. User Eligibility & Account Registration

To use our services, you must:

• Be at least 18 years of age
• Be a legal entity or individual authorized to enter into contracts under Indian law
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account

4. Payment Terms

• All prices are listed in Indian Rupees (INR)
• Plans are one-time payments valid for 1 year from activation date
• GST (Goods and Services Tax) at the applicable rate (currently 18%) may be charged in addition to the plan price as per Indian taxation law
• Payments are processed securely through RBI-approved, certified payment gateways
• SVIK SOLUTION does not store your payment card details
• All transactions are subject to verification and may be declined for fraud prevention purposes
• A valid GST invoice will be issued upon request for all purchases

5. No Misuse Policy

You agree NOT to use our services for:

• Sending spam, unsolicited, or illegal messages via the WhatsApp platform
• Violating Meta's WhatsApp Business API policies or any applicable laws
• Harassing, threatening, or harming any individual or organization
• Distributing malware, viruses, or harmful code
• Engaging in fraudulent, deceptive, or illegal activities
• Attempting to reverse engineer, copy, or resell our platform without authorization
• Using our platform for any activity that violates Indian laws, including IT Act 2000

Violation of this policy may result in immediate suspension or termination of your account without refund.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• SVIK SOLUTION shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the specific service in question
• We are not responsible for service interruptions caused by third-party providers (including Meta/WhatsApp API downtime), internet outages, or events beyond our control
• We do not guarantee specific business outcomes, revenue generation, or results from using our services
• SVIK SOLUTION makes no warranties regarding income guarantees or financial returns

7. Intellectual Property

All content on our website and within our platforms — including but not limited to software, code, logos, text, graphics, and documentation — is the intellectual property of SVIK SOLUTION and is protected under applicable Indian and international intellectual property laws. You may not reproduce, modify, or distribute any of our content without prior written consent.

Custom software developed for you as a client will have ownership terms defined in your specific project agreement.

8. Service Availability

We strive to maintain 99%+ uptime for our platform. However, we do not guarantee uninterrupted access and may occasionally perform maintenance. We will endeavor to provide advance notice of planned maintenance. Scheduled downtime does not entitle users to refunds.

9. Account Termination

SVIK SOLUTION reserves the right to:

• Suspend or terminate your account immediately upon breach of these Terms
• Terminate accounts found to be involved in fraudulent or illegal activities
• Discontinue services with reasonable notice (30 days) for legitimate business reasons

You may cancel your account at any time. Termination does not automatically result in a refund. Please refer to our Refund Policy for eligibility criteria.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website with at least 15 days' notice. Continued use of our services after the effective date of changes constitutes acceptance of the revised Terms.

11. Governing Law & Jurisdiction

This includes all disputes arising from your use of our services, payment disputes, or any other matter related to this agreement.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
